Proposed Redetermination of mean of passage to be by pedal cycle and foot only)

NOTICE IS HEREBY GIVEN THAT the East Dunbartonshire Council propose to make an Order under Section 152(2) of the Roads (Scotland) Act 1984 to redetermine the means of the public right of passage over areas of the lengths of footways as described in the Schedule hereto.

The title of the proposed order is THE EAST DUNBARTONSHIRE COUNCIL (A807 AUCHENHOWIE ROAD) (REDETERMINATION OF THE MEANS OF PASSAGE TO BE BY PEDAL CYCLE AND FOOT ONLY) ORDER 20XX.

A copy of the proposed order and the accompanying plan showing the lengths of footway over which the means of exercise of the public right of passage is to be redetermined, together with a statement of reasons for proposing to make this Order, are available for inspection without payment of fee in the Roads section of the East Dunbartonshire Council website. Proposed Order
(Redetermination of mean of passage to be by pedal cycle and foot only) Order 20XX

The East Dunbartonshire Council in exercise of the powers conferred on them by section 1(1) and 152(2) of the Roads (Scotland) Act 1984 and all other enabling powers hereby make the following Order.

  1. This Order may be cited as “The East Dunbartonshire Council (A807 Auchenhowie Road) (Redetermination of Means of Passage to be by Pedal Cycle and Foot Only) Order 20XX“ and shall come into operation on XXXX;
  2. In this Order the following expressions have the meanings hereby assigned to them:-

“Cycle track” has the same meaning as that given in Section 151 of the Roads (Scotland) Act 1984; and
“Pedal cycle” has the same meaning as that given in Section 151 of the Roads (Scotland) Act 1984.

  1. The lengths of road specified in the Schedule to this Order, which at present comprise footway, shall become cycle track with the right of passage being exercisable on pedal cycle and foot only.

Statement of Reasons for Proposing to Make the Above Order

Statement of Reasons for Proposing to Make the Above Order

It is considered necessary to make the above order in the interests of road safety for some of the most vulnerable road users (i.e., those walking, wheeling and cycling) by providing dedicated space away from the carriageway for travelling in this way. This order is associated with the A807 Active Travel Corridor project.
