Building Standards charges

The Council can provide the following services in relation to its Building Standards functions, for which charges are set on an annual basis.

CURRENT CHARGES

 
Dangerous Buildings - Where work is undertaken by the Council in default of an owner to make a dangerous building safe or otherwise to prevent access to the building or its vicinity – an invoice will be raised for costs incurred including administrative costs. Time/Cost basis

Note: Access to inspect and obtain copies of documents held in Building Warrant records is restricted by regulation 58 of the Building (Procedure) (Scotland) Regulations 2004 as amended which may preclude persons other than the owner/ relevant person and other prescribed interested persons from obtaining copies of documents.
 
Search of Building Standards records back to May 1975 for copies of Building Warrant and other papers relative to the warrant/copies of other papers in relation to a specific property where still held or otherwise to provide letters of confirmation. Search and retrieval of warrant file/ records including amendments - £78.00 plus £52.00 for each additional warrant file to retrieve and copy principal documents i.e. warrant, completion certificate submission (excluding drawings) or to provide confirmation where not held.
Copies of documents - Where no search is required and  Building Warrant reference number back to May 1975  is provided to Council, for retrieval and copy of Building Warrant and other papers/copies if still held or otherwise to provide letters of confirmation. £52.00 to retrieve and copy principal documents i.e. warrant, completion certificate submission (excluding drawings) or to provide confirmation where not held.
Confirmation of Completion service – Where a Building Warrant was obtained under the Building (Scotland) Act 1959 but no application for a Certificate of Completion was submitted or accepted.  Inspection (and re-inspection after any minor remedial work if necessary) to provide a letter of intent with regard to there being no Certificate of Completion. For each Building Warrant record including amendments - £150.00

Notes: Where significant defects or contraventions are found, it may be necessary for a warrant to be obtained under the Building (Scotland) Act 2003 for the remedial work to be carried out and a Completion Certificate to be submitted for acceptance (or rejection) of the remedial work.

Confirmation of Completion for works carried out under a warrant obtained under the Building (Scotland) Act 2003- Provisions are made under regulation 19(4) of the Building (Procedure) (Scotland) Regulations 2004 that allow the Council, as a verifier under the Building (Scotland) Act 2003, to determine that a warrant which has expired should be valid for such further period as the verifier may determine. Should on application the warrant be extended, the provisions under the current legislation will still apply and this would allow a Completion Certificate under the 2003 Act to be submitted by the relevant person for consideration of its acceptance (or rejection).

To provide a qualified letter of comfort / intent, where building work has been carried out prior to 1975 and no inspection is being requested otherwise fees below would apply. £52.00
Unauthorised works/no records of warrant (for building works completed prior to 1 May 2005) - Initial inspection and a re-inspection with letter of intent. Discretion to charge additional fee in line with prescribed scale of lodging fees where cost of works considered in excess of £5,000. £350.00
Inspection to provide confirmation letter. (Where no inspection is required - advice is free). Exempted buildings and services, fittings and equipment where building regulations do not apply (Schedule 1 of Building (Scotland) Regulations 2004 as amended) £200.00

Notes:  Where works consist solely of operations for building and work, including the provision of services, fittings and equipment meet a description and limitations as set out in Schedule 3 of the Building (Scotland) Regulations 2004 as amended and do not require a warrant, general advice is available free of charge based on the information which is made available. 

If it is intended to carry out additional work that requires warrant approval at the same time, the work for which no warrant is otherwise required should be included in the application for a Building Warrant. 

The Building (Scotland) Regulations 2004 as amended set out the building standards which would still apply in full and enforcement action may be taken by the Council if the work was subsequently found not to meet with these standards.

Where no warrant is required, the Council does not provide additional assurances on whether work set out in schedule 3 when carried out meets the standards. It is up to the owner/ relevant person to therefore ensure they obtain any necessary confirmation from a suitably qualified person/ provider which may assist in showing future purchasers that work has been properly carried out.

Subsequent re-inspections after carrying out one of the above services where remedial works remained incomplete or defective. £85.00
