The Scottish Parliament wrote to selected stakeholders on 15 December 2025 calling for views to assist scheduling of formal consideration of these instruments in its forthcoming work programme
The Civic Government (Scotland) Act 1982 (Licensing of Non-surgical Procedures) Order 2026 will establish a new licensing scheme for some aesthetic and beauty practitioners which fall to local authorities and likely Environmental Health Officers and Legal Services to implement
This Order and related primary legislation aims to regulate non-surgical procedures, ensuring they take place in appropriate settings where standards of hygiene and safety can be met
The Scottish Government has grouped procedures into those which require to be licenced by Healthcare Improvement Scotland under the Non-surgical Procedures and Functions of Medical Reviewers (Scotland) Bill, and those which will be subject to the licensing regime run by local authorities by this Order
The procedures that will be subject by this Order and licenced by local authorities include: Chemical peels, Cryolipolysis (Fat Freezing), Cryotherapy, Electrolysis, High intensity focused ultrasound, Microneedling, Laser and Light Treatment and Radio Frequency treatments
The deadline for the response was the 9 January 2026 and given the short response time a technical response was sent on this date to the Scottish Parliament’s Health, Social Care and Sport Committee. A copy of the response is available from Evonne Bauer, Executive Officer Community Services.
