Privacy Notice

Who will process Your Information?

The personal data you provide to us and also any personal data we collect about you (“Your Information”) will be processed by East Dunbartonshire Council, 12 Strathkelvin Place, Kirkintilloch, G66 1TJ (the “Council”).

Why will Your Information be processed?

Your Information will be processed to help the Council to provide services to improve your knowledge and skills and help improve your prospects of progression to employment, volunteering or further training and education (called “Community Learning and Development Services”).

Your Information may also be shared with other departments within the Council or other organisations for the same purposes and also to:

  • ensure funding provided by other organisations for the provision of community learning and development services is properly used;

  • support you to access other services which may be of assistance to you;

  • monitor the effectiveness of the projects the Council offer, including aftercare services

  • provide financial support through Lift Off funds

  • check the information the Council holds is accurate;

  • prevent and/or detect crime; and

  • protect public funds.

Other organisations may include Skills Development Scotland, Jobcentre Plus,  bodies responsible for auditing or administering  public funds, other councils, public sector agencies, governmental departments, the European Commission, voluntary organisations and charities, regulatory and law enforcement bodies and other private companies or entities (such as service providers/contractors and/or partner bodies). 

Who will have access to Your Information

Your Information will be accessed by Council Staff who need to do so to administer the provision of Community Learning and Development Services within the local area. If such administration is provided on the Council’s behalf by an external agency, that agency will have access to Your Information

The Council is also required to ensure proper administration of its funds so details will be checked internally for fraud prevention and verification purposes. Information is also analysed internally in order to provide management information, inform service delivery reform and similar purposes.

Your Information may also be shared with other departments within the Council, Skills Development Scotland, Jobcentre Plus, bodies responsible for auditing or administering  public funds, other councils, public sector agencies, governmental departments, the European Commission, voluntary organisations and charities, regulatory and law enforcement bodies and other private companies or entities (such as service providers/contractors and/or partner bodies). 

The Council will also generally comply with requests for specific information from other regulatory and law enforcement bodies where this is necessary and appropriate.

Set out below are examples of who the Council share your information with and why:

Example 1:

  • East Dunbartonshire Council’s accounts are required to be audited by the Accounts Commission. Your Information may be shared with the Accounts Commission or any auditors they appoint as part of the audit under section 97B of the Local Government (Scotland) Act 1973.

Example 2:

  • The Scottish Government or European Union may fund some of the work the Council undertakes to increase your skills and employability. To ensure that the funding is used on what it is meant to be these organisations may require the Council to pass certain of Your Information to them. This is to make sure the Council is allocating the funding appropriately. It also allows the organisation to monitor how effective the funding project is.

Who  provides information to the Council?

Some of the information East Dunbartonshire Council hold about you e.g. name, address and contact details may come from third party sources. For example the Council may be given personal information about you by another national agency including Jobcentre Plus, Skills Development Scotland or a voluntary organisation. They will have done this with a view to assisting the Council provide you with community learning and employability services.

What is the Council’s lawful basis for processing Your Information?

The processing of Your Information is necessary for the Council to comply with its legal obligations under:

  • the Requirements for Community Learning and Development (Scotland) Regulations 2013 (obligation to provide, maintain and facilitate a community learning and development service within the local area)
  • the Local Government (Scotland) Act 1973 (to ensure proper administration of the Council’s financial affairs) (including the detection and/or prevention of fraud)
  • the Local Government (Scotland) Act 1973 (furnishing of information and documents to the Commission)

The Council may use Your Information to provide to you details of the Council services available. Before sending you any marketing material the Council will ask for your consent and how you would like to receive this e.g. by mail, telephone or email. You do not have to consent if you do not want to.

Do you have to provide Your Information?

You do not have to provide Your Information to the Council. Without the relevant information about you however the Council may not be able to provide you with any of the Skills for Learning, Life and Work services.

How long will you keep the information?

The Council uses the Scottish Council on Archives Records Retention Schedules to manage the amount of time the Council keeps information. Further information on these can be found on the Scottish Archives website.

The information you have provided is classed as Life Long Learning (SCARRS Ref 10.008.001 and 10.008.001:

  • We will retain the data you have given us for 2 years from the date of last action in respect of the data.
  • Where the services we provide are funded by other bodies we require to retain your data for the period specified by the body funding the service.

Rights over the Information held by the Council

  • Right of Access

You have the right to access the personal data the Council holds about you. This right is called a Subject Access Request, often referred to as a SAR.

You can receive a copy of your personal data held by the Council, details on why it is being used, who it has been/ will be shared with, how long it will be held for, the source of the information and if the Council uses computer systems profile or take decisions about you.   • Right to Rectification

You have the right to request the Council correct any information held about you that is inaccurate.

  • Right to Erasure

You have the right to request that the Council deletes the personal data held about you. This right is known as the right to be forgotten.

  • Right to Restrict Processing

You have the right to request that the Council stops using your personal data, while retaining a copy of it.
